TERMS OF SERVICE AND VOD SUBSCRIPTION AGREEMENT

THE WAY TO ABUNDANCE (original: Droga do Obfitości®)

§ 1. DEFINITIONS & SERVICE PROVIDER IDENTIFICATION

1. Service Provider / Owner – ARIA Anna Duszyńska, registered in the Polish CEIDG register, Tax ID (NIP): 7322063903, contact email: akademiaaria@gmail.com (hereinafter the “Service Provider”).

2. Platform – the password-protected digital platform hosted at https://akademiaaria.com.pl (powered by Publigo).

3. Course / Program – digital educational and personal development video programs, specifically including Droga do Obfitości® and Akademia Obfitości.

4. User / Client – an individual (Consumer or Sole Trader with Consumer Protection), legal entity, or business unit (B2B Client) entering into this Agreement.

5. Subscription – a recurring billing model where fees are automatically charged to the User’s payment card on a monthly basis.

6. DSA – Regulation (EU) 2022/2065 (Digital Services Act).

In plain English: Here we formally identify our company and define the core concepts used throughout this agreement.

§ 2. PROGRAM NATURE & MENTORING/EDUCATIONAL DISCLAIMER

Programs available on the Platform are purely educational, motivational, and mentoring materials for personal growth.

2. Medical & Healthcare Disclaimer:

– Content, guided meditations, and internal exercises do not constitute medical, psychiatric, or psychological advice and cannot replace licensed clinical treatment.

– The User participates voluntarily, confirming they are in sound mental and physical condition, and assumes full responsibility for applying the knowledge.

3. Contraindications: Participation is contraindicated for individuals experiencing acute psychiatric conditions, severe unaddressed trauma, or medical conditions where deep meditation is inadvisable.

4. The Service Provider makes no guarantees regarding specific financial, material, or lifestyle results, as outcomes depend entirely on the User’s personal application and circumstances.

In plain English: Our courses provide educational, self-development, and mentoring content. They do not constitute medical therapy or psychiatric treatment. You are fully responsible for your own journey and decisions.

§ 3. ACCESS & TECHNICAL SPECIFICATIONS

1. Requirements for platform access: broadband internet connection (min. 10 Mbps), an up-to-date web browser, an active email account, and the capability to stream embedded YouTube video players.

2. Access credentials are automatically delivered via email upon successful payment confirmation.

3. Access is granted for the specific timeframe indicated at checkout. Discretionary access extensions of 4 to 8 weeks may be requested via email under justified circumstances.

In plain English: Access is 100% digital. Login credentials are created automatically in Publigo immediately after successful payment.

§ 4. ONE-TIME PAYMENTS AND INSTALLMENTS (4 or 6 MONTH COMMITMENT)

1. All prices displayed on the Platform are gross amounts (including VAT where applicable).

2. Payments are securely processed via certified payment gateways: Stripe, PayU, Przelewy24, Paynow.

3. Installment Payment Plan (4-Month Fixed-Term Commitment):

– Selecting installment payments constitutes entering into a single, indivisible 4-month fixed-term Agreement with access granted for that period and payment divided into 4 equal monthly installments, due by the 10th day of each calendar month.

– If any installment is overdue, access to the VOD Platform will be automatically suspended until payment is cleared (access is restored within up to 72 hours after settlement).

– If payment is delayed by more than 14 days following an electronic payment reminder notice, the entire remaining balance for the 4-month contract term becomes immediately due and payable.

In plain English: You can pay for the course in full upfront or in 6 monthly installments. Opting for installments means entering into a single, indivisible 4-month contract, not a subscription you can cancel halfway through.

§ 5. RIGHT OF WITHDRAWAL (DIGITAL CONTENT)

1. Consumers generally hold a 14-day statutory right of withdrawal from distance contracts.

2. Pursuant to Art. 38(1)(13) of the Polish Consumer Rights Act, the right of withdrawal expires once the performance of digital content supply has begun with the Consumer’s prior express consent before the 14-day period lapses, accompanied by acknowledgment of the forfeiture of such right.

In plain English: Because you receive immediate access to digital VOD assets upon purchase, giving prior express consent waives your 14-day statutory right of withdrawal.

§ 6. TRADEMARK & INTELLECTUAL PROPERTY PROTECTION

1. Registered Trademark: The mark Droga do Obfitości® is a legally registered trademark protected under Right of Protection No. Z.536425 granted by the Patent Office of the Republic of Poland to ARIA Anna Duszyńska. Unauthorized use is strictly prohibited.

2. Copyright & Single-User License: All audio/video materials, worksheets, and texts are protected by copyright law. The purchase grants a single-user, non-exclusive, non-transferable personal learning license.

3. Strict Prohibitions: Sharing login credentials, recording screens, downloading streaming video files, reselling, or teaching proprietary methodologies commercially without written authorization is illegal and strictly forbidden.

In plain English: The Way to Abundance (oryginal: Droga do Obfitości®) is a registered trademark and all videos are copyright protected. Your access is for you alone—no account sharing, screen capturing, or redistributing.

§ 7. COMMUNITY COMMENTS & DSA NOTICE PROCEDURE

1. Users may post comments and participate in community threads during active community cycles.

2. Hate speech, defamation, unauthorized marketing (spam), and unlawful content are strictly prohibited.

3. DSA Contact Point: Reports of illegal content under the Digital Services Act must be sent to: akademiaaria@gmail.com.

4. Notices are processed promptly under our Notice and Action procedure.

In plain English: Platform comments and community spaces are moderated. Unlawful content or spam will be removed. Contact our DSA email to report violations.

§ 8. VERIFIED REVIEWS (OMNIBUS DIRECTIVE)

1. Reviews published on the Platform are collected automatically through Publigo.

2. The system’s technical architecture permits review submissions only from authenticated Users who hold an active, verified purchase of the respective Course.

3. The Service Provider never commissions incentivized or unverified reviews.

§ 9. COMPLAINTS, SLA & FINAL PROVISIONS

1. Technical or service complaints should be sent to akademiaaria@gmail.com and will be answered within 14 days.

2. In the event of a platform outage exceeding 24 consecutive hours attributable solely to the Service Provider, access duration will be extended proportionally.

3. The Service Provider may update these Terms for valid reasons upon giving 14 days’ email notice. Polish law shall govern all contracts.
